    • Like kind does not mean if you are selling a commercial building, you have to purchase another commercial building. Like kind just means selling investment real estate to buy investment real estate. The asset must produce income. You could sell a commercial building and purchase a duplex, or an apartment building, or a long-term single family rental home…as long as it is income producing real estate you can exchange!

    • Certain rules apply to personal use of investment property

  • Strict identification and exchange timelines apply

  • Proper documentation and use of a qualified intermediary are required to avoid constructive receipt of proceeds

  • Tax deferral is not tax elimination; consult your tax advisor about long-term tax planning and potential state tax implications
